The ground rules for working together, in plain language.

In short
These terms apply to every quote, agreement and service from MartinHols.com, part of The Arrows (“I”), with a client (“you”). Anything different only counts if we agree it in writing. Email is fine. Your own general terms don’t apply.
A quote is valid for 30 days. The booking is confirmed when you accept the quote in writing, or when I confirm your request. The quote states the date, hours, location, deliverables and price.
If the plan changes, I will send an updated quote.
I work with professional equipment and backup gear, in the style you see in my portfolio. I follow your brief and shot list where I can. I can’t guarantee specific shots at live events, because things happen fast.
Delivery times are in the quote. At events with fast delivery, I deliver high-quality, fully edited photos during the event. This usually relies on a good connection or on partners at the event, which we agree beforehand. The rest of the edited photos follow within 24 hours after the event, unless we agree otherwise.
All prices are in euros and exclude VAT. Travel and extra costs are agreed in advance. Hours beyond the booking are charged at the agreed hourly rate.
Invoices are due within 14 days of the invoice date. For larger jobs I may ask for a deposit of 50% before the event. If a payment is late, the statutory commercial interest and reasonable collection costs apply.
Life happens. This is how I handle it:
To do my best work I need:
I keep the copyright in all photos, under the Dutch Copyright Act. You get a non-exclusive licence for the use stated in the quote, normally your own marketing, communication, press and social media. The licence has no time limit, can’t be transferred, and doesn’t cover resale or stock use.
Please credit “Photo: Martin Hols” where that is reasonable, for example in press and on social media. Light edits such as cropping and colour matching for a platform are fine. Edits that change the meaning of a photo are not.
Other use, such as advertising campaigns or merchandise, needs an extended licence agreed in advance. For use without a licence, I charge an extra fee of 100% on top of the normal licence fee.
You are responsible for informing visitors that photography takes place and for the permissions needed at your venue. I am not liable for claims that come from restrictions I was not told about.
I may use the photos in my portfolio, on my website and social media, in awards and in my own promotion. If an event is confidential, tell me before the job and we will agree this in writing.
Raw files are not part of the delivery. I keep the edited photos for at least 2 years, but please keep your own copy.
If something is wrong with the delivery, tell me in writing within 7 days. I will fix it where I reasonably can, for example with a new edit.
I am only liable for direct damage caused by my intent or gross negligence, up to the invoice amount excluding VAT. I am not liable for indirect damage, or for things outside my control such as a denied access, a cancelled act, weather, or equipment failure despite proper backup.
If I can’t make it, for example because of illness, I will arrange a replacement photographer of similar quality from my network. Nothing in these terms limits liability that the law does not allow me to limit.
If an event is cancelled or can’t go ahead because of circumstances nobody can control, neither of us is in breach. We will look together for a fair solution, such as a new date.
Dutch law applies. We will first try to solve any dispute together. If that doesn’t work, it goes to the competent court in the Netherlands.
